GPS Bentuk Kerajaan Wilayah

Gabungan Parti Sarawak (GPS) telah memenangi Pilihan Raya Wilayah Sarawak bagi membentuk kerajaan wilayah baharu selepas menang 76 daripada 82 kerusi pada Pilihan Raya Wilayah Sarawak ke-12.

GPS di bawah pimpinan Ketua Menteri, Tan Sri Abang Johari Abang Openg, menang di 76 kawasan Dewan Undangan Negeri (DUN) Sarawak, berbanding pembangkang yang hanya menang enam kerusi.

Parti-parti PKR, PAN, Aspirasi dan PBK antara yang langsung tidak memenangi mana-mana kerusi, dan hanya PSB dan DAP sahaja yang berjaya memperoleh empat dan dua kerusi masing-masing.

Abang Johari yang pertama kali bertanding di kerusi DUN Gedong selepas berpindah dari DUN Satok yang disandangnya sejak sembilan penggal lalu, menang dengan 4,310 undi.

Beliau menewaskan calon Parti Sarawak Bersatu (PSB), Mohamad Sofian Fariz Sharbini, yang memperoleh 703 undi, calon Parti Amanah Negara, Cikgu Kamal (94 undi) dan calon Parti Bumi Kenyalang, Tomson Ango (157 undi).

Setakat jam 6.45 petang, Gabungan Parti Sarawak telah memenangi dua kerusi dan mendahului di kebanyakan kawasan dalam Pilihan Raya Wilayah Sarawak ke-12.

Kawasan DUN N27 Sebuyau dan N65 Belaga telah sah dimenangi oleh gabungan parti itu dengan majoriti 4,134 dan 2,245 masing-masing, setakat ini, menurut Suruhanjaya Pilihan Raya Malaysia.

Menurut laporan Malaysiakini, GPS turut memenangi tiga lagi kerusi lain iaitu di N37 Bukit Saban, N58 Balingian dan N66 Murum, namun pihak kami belum dapat mengesahkan hal tersebut serta perinciannya.

Pengundi Sarawak Ditimpa Hujan Lebat, Angin Kencang

Proses Pilihan Raya Wilayah Sarawak menghadapi sedikit rintangan apabila beberapa kawasan di wilayah tersebut ditimpa hujan lebat sejak awal pagi tadi, mengakibatkan proses pembuangan undi terganggu.

Kanopi-kanopi dilaporkan tercabut akibat angin kencang sehinggakan ia perlu dialih ke kawasan yang lebih selamat.

Menurut laporan Malaysiakini, sebuah kanopi pegawai kesihatan di kawasan perlu dipindah kerana hampir rosak apabila ditiup angin yang kuat.

Walaupun dalam keadaan cuaca yang buruk, pengundi tetap meredah hujan yang lebat bagi meneruskan proses pemilihan di wilayah tersebut.

Sebelum ini Suruhanjaya Pilihan Raya Malaysia (SPR) telah menyarankan warga wilayah untuk mengundi pada awal hari kerana kebanyakan tempat di Sarawak dijangka akan ditimpa hujan lebat pada sebelah petang.

Namun begitu, sesetengah kawasan seperti Bawang Assan telah menghadapi hujan yang lebat seawal jam 8 pagi tadi.

Setakat jam 2.00 petang, seramai 48% pengundi atau kira-kira 580,000 pengundi telah membuang undi di serata negeri.

Pusat-pusat undi dijangka akan ditutup pada jam 5 petang nanti.

Sekitar 580,000 warga Sarawak telah keluar mengundi setakat jam 2.00 petang bagi proses Pilihan Raya Wilayah Sarawak ke-12 hari ini (lazimnya disebut PRN Sarawak).

Suruhanjaya Pilihan Raya melaporkan bahawa seramai 48% daripada pengundi berdaftar telah membuang undi dalam pemilihan yang diadakan hampir setiap 5 tahun itu.

Ini merupakan peningkatan sebanyak 4% sahaja sejak jam yang lepas iaitu 44% pada pukul 1.00 tengah hari.

Terdahulu, SPR telah melaporkan bahawa 32% telah keluar mengundi pada jam 11.00 pagi, 22% pada 10.00 pagi dan 11% pada 9.00 pagi.

Warga wilayah Sarawak disarankan untuk keluar awal bagi proses pemilihan kerana hujan lebat dijangkakan pada sebelah petang hari.

PRN Sarawak: 39% Keluar Mengundi Setakat 12 Tengah Hari

Kira-kira 470,000 rakyat wilayah telah keluar mengundi setakat jam 12.00 pagi hari ini bagi Pilihan Raya Wilayah Sarawak (lazimnya disebut PRN Sarawak).

Menurut laporan Suruhanjaya Pilihan Raya Malaysia (SPR), seramai 39% rakyat 1,252,014 pengundi berdaftar telah membuang undi dalam pemilihan yang diadakan hampir setiap 5 tahun itu.

Terdahulu, SPR telah melaporkan bahawa 32% telah keluar mengundi pada jam 11.00 pagi, 22% pada 10.00 pagi dan 11% pada 9.00 pagi.

Constitutionally Illiterate!

“We cannot accept Shariah law, for Malaysia already has a supreme law, which is the Federal Constitution. Article 4 of the Constitution declares it simply: ‘This Constitution is the supreme law of the Federation’,” Baru said as reported by Borneo Post Online with the tittle, “Baru concurs with Abg Jo on concerns over proposed amendment to Act 355”.

Constitutionally illiterate! This senseless statement makes me wonder if the PKR leader knows what he is trying to say. In fighting against a law that has nothing to do with him as a non-Muslim, the PKR man said, “Hadi Awang and Umno may say this is Syariah and not hudud, but as far as I understand it, hudud is part of the Syariah and the proponents had said this bill was to pave way for hudud punishments in Kelantan. This attempt at RUU355 is but a political contest between Umno and PAS to champion the implementation of Syariah Law in Malaysia.”

Yes, Article 4 of the Constitution declares that the Federal Constitution is the supreme law of the Federation, therefore the Shariah Court system is constitutional because Article 121(1A) confers the Syariah Courts systems as part of the Malaysian legal systems. Federal Constitution as the Supreme law of the land must not be misinterpreted and must be read as a whole.

In the judgement of the Federal Court case, Loh Kooi Choon v The Government of Malaysia [1977] 2 MLJ 187, the then Federal Court Judge, DYMM Almarhum Sultan Azlan Shah stated that, “Constitution as the supreme law, unchangeable by ordinary means, is distinct from ordinary law and as such cannot be inconsistent with itself”. Hence, it is wrong for Baru Bian to cherry-pick what he likes or bypassing other Articles in order to make his own interpretation to suit his argument and agendas.

If Baru Bian respects the Article 4, he must respect the fact that the Article 3(1) that says, “Islam is the religion of the Federation” for it is placed before the Article 4, hence stating the importance of Article 3. In the Court of Appeal’s judgement of the case, Titular Roman Catholic Archbishop of Kuala Lumpur v. Menteri Dalam Negeri and Kerajaan Malaysia, the then Federal Court Judge, Tan Sri Mohamed Apandi Ali explained that , “The Article places the religion of Islam at par with the other basic structures of the Constitution, as it is the 3 rd in the order of precedence of the Articles that were within the confines of Part I of the Constitution”. So by denying the acceptance of the Shariah laws, Baru Bian is literally against the Article 3(1) and therefore he is also against Supreme Law of the Federation.

If Baru Bian reads the Federal Constitution, he’ll understand that as the supreme law of the land, the Constitution defines the principles of our country, the sovereignty of Islam as the religion of the country, the sovereignty of the Rulers, the rights of the people, judicial system and other important laws but the Federal Constitution does not describe punishments and offences. It is the judiciary that interprets and applies the law in the name of our country through Act, Ordinance, Enactment and others. And there is no unconstitutional elements in the proposed amendment of the Act 355 because the Act 355 is an existing law, the proposed amendment is only to increase the Syariah punishments which are currently too low and not to introduce new sets of laws or seeks to widen the scope of its current jurisdiction.

Furthermore has Baru Bian forgotten or unaware of Article 11(3)(a) which says every religious group has the right to manage its own religious affairs? After all, why must the non-Muslims try so hard to deny the constitutional rights of the Muslims to manage our own religious affairs as granted by Article 11(3) of our Federal Constitution?

This is not a Hudud Bill and it is impossible for the amendment of Act 355 to enable the implementation of Kelantan’s Syariah Criminal Code II (1993) Enactment 2015 because it is not within the power of the Syariah Courts to implement capital punishment nor the jurisdiction over offences punishable under the Penal Code.

So, please stop debasing the Federal Constitution and as a leader, please at least learn to respect and uphold our supreme law.

A waterspout was seen in Bintulu, Sarawak along the Kidurong coast at about 10am on Saturday. 

Wikipedia wrote that waterspouts are non-supercell tornado over water; they are small and weak rotating columns of air over water and they do not suck up water.

The Star reported that an employee at Petronas’s Malaysia Liquefied Natural Gas LNG plant told The Star that the waterspout came close to the factory.

BERNAMA reported that the waterspout was also seen in Niah area of Miri.

There were also no reports of injuries or property damage in the incident.

KUALA LUMPUR: Air quality was at unhealthy levels in nine areas in the country as of 8 am, Tuesday, according to the Department of Environment (DOE).

The affected areas are Samarahan, which recorded an Air Pollutant Index (API) reading of 118, Sibu (185) and Sri Aman (113) in Sarawak; Banting (136), Port Klang (127) and Petaling Jaya (102) in Selangor and Batu Muda (124), Cheras (122) and Putrajaya (125) in Kuala Lumpur.

Twenty other places recorded moderate air quality.

An API reading of between 0 and 50 is considered good; 51 to 100, moderate; 101 to 200, unhealthy; 201 to 300, very unhealthy; and 301 and above, hazardous. – Bernama
