Jika Zakir Naik disekat, Siti Kasim Juga Perlu Disekat

[Menara.my}- Menara.my, dalam artikel yang bertajuk, “Siti Kasim: Ajaran Dr Zakir Naik Bertentangan Dengan Islam” melaporkan penentangan keras oleh Siti Zabedah Kasim terhadap Dr Zakir Naik yang mana menurut Siti Kasim, membawa ajaran Islam yang bertentangan dari ajaran yang termaktub dalam kitab Al-Quran.

Menurut laporan tersebut, Siti Kasim berkata, “Sebenarnya, kebebasan bersuara yang kami laungkan ini tidak boleh disamakan dengan kes Dr Zakir Naik”. Perkara ini menarik perhatian saya kerana kenyataan itu menunjukkan dengan jelas sikap ‘double standard’ yang diamalkan oleh Siti Zabedah Kasim dalam hal hak asasi manusia, khasnya hak kebebasan bersuara yang diperjuangkannya. Nampaknya, Siti Kasim mahukan hak kebebasan bersuara hanya untuk dirinya dan mereka yang sependapat dengannya sahaja, namun untuk mereka yang tidak menyokong pendapatnya mesti dikenakan batasan dalam hak kebebasan bersuara.

Dalam hal ini Siti Kasim nampaknya terlalu mengikut perasaan dan lupa untuk mencermin dirinya dahulu sebelum bertindak. Jika beliau inginkan sekatan ke atas Dr. Zakir Naik daripada “bebas menyampaikan ajaran serta ceramahnya yang jelas bertentangan dengan landasan Islam sebenar dan prinsip negara”, dia tidak boleh marah dan membuat bising apabila umat Islam mahu Siti Kasim disekat atas sebab-sebab yang sama seperti tuduhannya terhadap Dr. Zakir Naik.

Sebagai aktivis hak asasi manusia yang selama ini menentang semua sekatan yang dikatakan mereka sebagai satu tindakan diskriminasi, sepatutnya Zabedah mempertahankan hak asasi penceramah itu. Malah, selama ini Siti Kasim mempertahankan kebebasan bersuara orang-orang yang menghina hukum Allah. Oleh itu, tindakan Siti Kasim kali ini juga adalah satu tindakan yang tidak adil kerana mendiskriminasikan hak golongan lain.

Seperti mana Siti Kasim mahu Dr. Zakir Naik disekat, saya yakin majoriti umat Islam di Tanah Air kita juga mahukan sekatan yang sama ke atas Siti Kasim atas sebab-sebab yang sama seperti yang diberikannya untuk menyekat Dr. Zakir Naik. Saya menggunakan kata-kata Siti Kasim seperti yang dilaporkan oleh Menara.my dan hanya menukar nama Dr Zakir Naik kepada nama Siti Zabedah Kassim.

Dalam realiti yang berlawanan, kata-kata Dr Zakir Naik mungkin berbunyi, “Berapa ramai yang berminat untuk membuat semakan dan kajian mengenai apa yang Siti Kasim cakap? Sebenarnya apa yang dikatakan oleh Siti Kasim semuanya boleh dikatakan “Rubbish” (sampah).

Siti Kasim menuduh Dr. Zakir Naik mengajar “Ajaran Islam dan ceramah yang dilakukan Dr Zakir adalah bertentangan dari ajaran Al-Quran yang boleh mengakibatkan perpecahan antara kaum di negara ini”, tetapi sebenarnya itulah yang dilakukan oleh Siti Kasim sendiri. Lebih teruk lagi Siti Kasim juga menolak dan membantah semua autoriti agama, fatwa-fatwa dan ajaran Islam yang sebenar kerana ianya bercanggah dengan tafsiran Islam yang dibuat sendiri.

Dan Siti Kasim juga selalu cuba “memberi fatwa” tentang hukum Islam, walaupun dia bukanlah seorang pakar berkenaan Islam, malah seorang aktivis liberal yang sebenarnya menentang hukum-hukum Islam.

Malah, dia terkenal kerana lantang menentang pemerkasaan institusi-insttusi Islam di Malaysia, contohnya dalam kes Pindaan Akta 355. Dia juga merupakan antara orang yang lantang mempertahankan golongan LGBT di Malaysia walaupun hal itu adalah bertentangan dengan ajaran Islam. Hukum Hudud yang belum dapat dilaksanakan pun dikritik oleh Siti Kasim, seolah-olah Islam dan undang-undang Islam adalah tidak adil.

Oleh itu, dimana logiknya Siti Kasim mahu melabelkan orang lain sebagai ekstremis dan menentang ajaran Islam yang sebenarnya, apabila dia sendiri yang menentang Islam selama ini?

Walaupun Siti Kasim mengatakan dia mempunyai hak kebebasan bersuara, tetapi kebebasan bersuara di Tanah Air ini masih ada batasan-batasannya dan ianya tertakluk kepada Akta Hasutan. Adalah bercanggah dengan undang-undang Tanah Air kita jika Siti Kasim menghasut orang ramai untuk menentang autoriti agama, fatwa dan ajaran Islam Ahli Sunnah Wal Jamaah yang diamalkan di Tanah Air kita.

Jika Siti Kasim mengatakan Dr. Zakir Naik seorang ekstremis yang menghasut, begitu juga dengan dirinya sendiri kerana liberal juga adalah ekstrem kerana liberalisme bermaksud menolak asas-asas agama dan asas-asas negara.





Melbourne Plane Crash, Victims Named (Photos)

A commercial charter flight heading from Essendon Airport in Melbourne to King Island in the Bass Strait crashed in a “massive fireball” into a shopping center near the airport, shortly after takeoff killing all the five people on board.

Sky News reported that the Beechcraft Super King Airplane came in ‘low and fast’ before it crashed onto DFO (Direct Factory Outlet) at Essendon Fields at about 9am on Tuesday, February 21, 2017.

The twin-engine aircraft which was owned by Myjet had been hired by Corporate and Leisure Travel.

None of the staff at the shopping center which was not yet open to the public was injured or killed.

News Corp has confirmed the identity of the pilot as an Australian man named Max Quartermain while the United States state department has confirmed to US network NBC in a statement that all of the four passengers were Americans. 

According to Sky News report, two of the four passengers are Greg Reynolds De Haven and Russell Munsch, as being named by their families on social media.

Police said that the plane had a “catastrophic engine failure” and was turning back to the airport before it crashed.

Both the Essendon airport and the DFO shopping centre are closed to allow for investigations.

I May Be 13, But I Deserved A Fair And Honest Report

Three articles written by two different news portals regarding the case of Lim Guan Eng’s seditious statement on November 23, 2016, highlighted my police report.

One of the articles came from MalaysiaKini while the other two were from Free Malaysia Today.

I was quite surprised to see the two news portals highlighting my police report, especially Free Malaysia Today (FMT), that wrote an article specifically on the matter.

FMT’s article, “Police query Guan Eng over report lodged by 13-year-old” ‘interestingly’ was written without getting the facts right.

I wonder whether FMT intentionally did so to sensationalised the issue or because they did not bother to get their facts right. 

According to the police report sighted by FMT, the 13-year-old Form 1 student from Ampang, Selangor, lodged the report because he felt that Lim’s post dated Nov 23, 2016, was against the amendment of the Syariah Courts (Criminal Jurisdiction) Act 1965, currently being pushed by PAS in the Dewan Rakyat.

For the record, I will not be making the police report just because I think that LGE is against the amendment of Act 355.

It was done because LGE’s words were seditious; therefore, violated the Laws of Malaysia. 

And with his position as a party leader, his false accusations can spread hatred which can lead to wild actions among certain groups of people.

We are living in a multi-racial country and we had experienced the racial tragedy of May 13, 1969; so we have to learn the lesson well.

The tragedy was the reason why the Section 3(1)(f) was added to the Sedition Act, in order to avoid such future incident and to maintain a healthy relationship among the people of all races in Malaysia.

I love my country and I do not want to see the peaceful and harmonious lives that we are enjoying now being shattered by such malicious words and actions.

I feel that LGE’s malicious accusations can promote the feelings of ill-will and hostility between Islam and other religions in Malaysia where his statement gives the impression that the Muslims are unfair and extreme.

In fact, LGE had indirectly questioned the sovereignty of the Rulers when he went against the then DYMM Yang Di-Pertuan Agong’s decree:

“Beta berharap langkah-langkah ke arah memperkukuhkan institusi agama dan kecekapan perlaksanaan undang-undang pentadbiran agama Islam melalui pemerkasaan Mahkamah Syariah dapat disegerakan.”

I did not make the report because Lim Guan Eng is against the amendment, but I made the report because Lim Guan Eng seditious words violated the Laws of Malaysia.

To FMT, please write fair and honest reports.





Act 355: G25, Stop Lying About Hadi’s Private Bill

On June 1, 2016 the Malay Mail Online reported that:

G25 criticised today PAS President, Dato’ Seri Haji Hadi’s  Private Member’s Bill to expand the range of punishments the Shariah courts can impose, saying hudud law is inappropriate in secular Malaysia”.

In order to support its arguments, G25 made a contradictory and baseless statement:

“Although Article 3 of the Federal Constitution declares that Islam is the religion of the Federation, still, constitutionally, Malaysia is a secular state, as our forefathers and the framers of the Federal Constitution had intended. Further, our nation is multi-religious, multi-racial and multi-cultural,” it added.

How could a country be constitutionally a secular state when its Federal Constitution which is the Supreme Law of the land  has declared that Islam is the religion of the country and the word “secular” has never been mentioned in the Federal Constitution?

Does G25 misunderstood the term secularism or is G25 trying to say that the Article 3 of the Federal Constitution is unconstitutional?

If Malaysia is a secular state, the word “Islam” cannot even be mentioned in the Federal Constitution of Malaysia.

The creator of the term secularism, George Jacob Holyoake , in his book, “The Principles of Secularism”, defines secularism as separating government and religion, while Merriam-Webster defines secularism as “the belief that religion should not play a role in government, education, or other public parts of society”.

So, Article 3(1) automatically denies any claim saying that Malaysia is a secular state; since secularism means separating government and religion which is the opposite case in Malaysia.

A good example of an important criteria of a secular state is the 25-year legal battle regarding the Mount Soledad Cross, a giant cross installed on Mount Soledad Veterans Memorial in the United States of America.

After a group of people installed a giant cross on the Mount Soledad Veterans Memorial in San Diego, California, the court ordered them to remove the cross, because as a secular state it is unconstitutional to put a symbol of religion on government land.

The controversy over the Mount Soledad Cross only ended after the US Department of Defense sold the government land on which the 29-foot cross stood.

So how could Malaysia be claimed as a secular state when the government not only built mosques on government lands but also finances Islamic religious authorities?

They noted that by implication, the Bill allows Shariah courts to impose “any form of hudud punishment” other than the death penalty, for example 100 lashes of whipping for Muslims found guilty of adultery, or the amputation of one’s hand for theft.

What a defamation and malicious falsehood!

Firstly, it is a lie to claim that the Private Bill is a Hudud Bill “to impose any form of hudud punishment other than the death penalty” and “to expand the range of punishments the Shariah courts can impose”, because the Bill is only to enable amendments to be made to the existing Act 355 Syariah Courts (Criminal Jurisdiction) Act so that the Syariah Courts can increase the punishments for the cases under the courts’ jurisdictions.

Secondly, as the above statement gives the implication that Hudud punishment is harsh and negative it is a defamation to Islam.

Thirdly, it is a false statement to say that the Bill will allow the Shariah Courts to impose the “amputation of one’s hand for theft” because, since theft is a criminal crime that is punished under the Penal Code, theft is under the jurisdiction of the civil courts and not the Syariah Courts.

The Syariah Courts have jurisdiction only over the matters as stated in the State List under Item 1 of the List II of the Ninth Schedule of the Federal Constitution and not over other offences; and the Bill is not about giving the Syariah Courts the jurisdiction over the offences punished under the Penal Code.

The Malay Mail Online further wrote:

The group noted that the Kelantan Syariah Criminal Code II (1993) Bill 2015 prescribes  hudud punishments for offences like adultery, theft, robbery, sodomy, consumption of liquor and apostasy, but it has yet to be enforced due to the limits in the Syariah Courts (Criminal Jurisdiction) Act.

“Therefore, there is the need for the state of Kelantan to seek Parliament to amend the Syariah Courts (Criminal Jurisdiction) Act 1995. And, so, here comes Hadi’s Bill,” said G25.

It is untrue that the Bill is about to enable the Kelantan Syariah Criminal Criminal Code II to be implemented because as I wrote above, the Bill will not gives the power to the Syariah Courts to implement capital punishment Hudud nor the jurisdiction over offences punished under the Penal Code.

It is hard to understand why a Muslim opposes a Bill that not only helps to curb the social problems among the Muslims but also to empower the Syariah Courts.

The Article 37 states that the Yang Di-Pertuan Agong must take his oath to protect the religion of Islam before exercising his functions; and this Bill is the right move towards protecting and upholding Islam which is the religion of our country.
